The terms ‘Students Art World’ and ‘The Student Art Company’ or ‘We’ or ‘Our’ or ‘Us’ refers to the owner of the website. The terms ‘You’ or ‘Your’ or ‘Users’ or ‘Buyer’ or ‘Seller’ or ‘Members’ refers to the user or viewer of Our website. Please read the following Terms and Conditions ‘Terms’ carefully.

Students Art World provides a ‘Service’ for selling and purchasing: (i) Original Artworks (ii) Copies or Prints (iii) Market Items. These are accessible at www.studentsartworld.com the ‘Site’. Members can also create and post: (i) Events (ii) Groups (iii) Forum topics and posts (iv) Ideas (v) Artworks to exhibit only (vi) comments. You must accept all the Terms in order to use these Services.

BY ACCESSING OR USING THE SITE OR SERVICES OR BY POSTING CONTENT ON THE SITE, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE TERMS, WHETHER OR NOT YOU HAVE REGISTERED WITH THE SITE. IF YOU DO NOT AGREE TO THESE TERMS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE OR SERVICES.

The use of this website is subject to the flowing terms of use:

Modification: Students Art World reserves the right, at its sole discretion, to modify, discontinue or terminate the Site or to modify these Terms at any time and without prior notice. If we modify these Terms You will be asked to re-accept the Terms and Conditions next time you log on. We will also notify you either by internal or external mail/ messages. By continuing to access or use the Site or Services after we have posted a modification on the Site or We have provided You with a notice of a modification. You are indicating that you agree to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only choice is to cease using the Site and its Services. Account Registration: In order to sell or purchase artworks or exchange art equipment and materials or submit content through Our Site, You must first create an ‘Account’ by completing our registration process. You will be required to pick an Account type during registration. Upon completion of our registration process you will become a member with one of the following account types: ‘Student’, ‘Art Student’ or ‘Art Collector’. You must provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete.

Account types: There are three account types: ‘Student’, ‘Art Student’ and ‘Art Collector’. Users can also upgrade to ‘Premium’ and request additional roles depending on account type. Users can choose to change their account type at anytime at www.studentsartworld.com/page/account-types.

‘Art Collector’ Accounts are free, and have restricted access to the Site and its Services. (no access to add Artworks or add Market Items)

‘Art Student’ Accounts are free until 31st December 2012, after which they will cost £5 per year. This account must be created and verified using your college or university email address. E.g. Name.Surname@education.ac.uk alternatively if you do not have a university or college email address but are a registered student please set up a ‘student’ account and contact us at useraccounts@studentsartworld.com

‘Student’ Accounts are free.

Our definition of a student at Students Art World: from the day you are born, till you die. Now seriously, from the day you are born until 5 years post graduation.   

‘Premium’ membership can be added onto any account. It costs £8 per month. (This is an extra on top of any other account charges. E.g. If a ‘Art student’ adds ‘Premium’ to their account they will be paying £5 for the year + £8 per month) If an ‘Art Collector’ gets ‘Premium’ their accounts will be changed to ‘Student’ + ‘Premium’. ‘Premium’ membership requires immediate payment for activation. Users can choose to pay monthly or to pay for the whole year in one go. Once Your ‘Premium’ membership expires All your promoted content will change to not promoted.

Cancelation/termination of accounts and services: Users can choose to close their accounts, to do this they must send a written confirmation to useraccounts@studentsartworld.com stating they wish to close their accounts. Students Art World will require full settlement of any outstanding monthly charges should these be due or overdue, prior to acceptance of any cancellation/ termination of accounts, 30 days notice is required. Equally if any money is due to You, this must be transferred before your account can be terminated.

Eligibility: Some of the Artworks posted on Students Art World may be considered as offensive and or improper. By Continuing searching whether a visitor or member you hereby acknowledge that You fully understand the implications that this viewing may incur. Students Art world and The Student Art Company don’t take any responsibility if any offense has been taken since the site is merely a platform for presenting artworks.

Flagging Content or Reporting Spam: If you see any content that you feel should be removed for any reason please report it to us. Users can flag content for moderation if they feel it should also be hidden, restricted or removed. Our Moderators will review each report and decide either to remove or keep this content. Alternatively please contact content@studentsartworld.com if you want to report anything else.

Seller Terms and Conditions

Overview: You acknowledge that you are solely responsible for all (i) ‘Original artworks’ (ii) ‘Digital Artworks’ (iii) Market Items (iv) Posts (v) Comments (vi) Events (vii) Groups. That you make available through the Site and Services.

Uploading Original Artworks on the Site: As a member you may upload ‘Original Artworks’ that you have created and you desire to sell through the Site and Services. You may not submit artworks that were created by another artist. Definition of Original Artworks is one of a kind or a specified number of limited editions.

Uploading Digital Artworks on the Site: As a member you may upload ‘Digital Artworks’ that you have created and you desire to sell through the Site and Services. You may not submit artworks that were created by another artist. Digital Artworks are defined as Artworks that are either Copies of Your Original Artworks or Artworks prints that can be reproduced and sold as either a number or as an unlimited number of prints.

Commissions for Artworks: Students Art World and The Student Art Company take a commission from each Artwork sold on Our Site. Each account has a different commission. ‘Students’ accounts are 15% on each Artwork sold. ‘Art Students’ accounts are 12.5% on each Artwork sold. ‘Premium’ accounts are 10% on each Artwork sold.

Commissions for Market: There is no commission taken on the Students Market when sales or exchanges are between Student and Student or Art Student and Art Student or Art Student and Student.

How is my Commission taken: When buyers purchase Artworks they pay The Student Art Company. When the Artworks have been posted and Delivered by the Student (Seller) to the Buyer. The Student Art Company will pay and or transfer the funds subtracting the commission for the Artworks and send this to the Students (Sellers).

Listing Market items on the Site

Student Market: As a ‘Student’ or ‘Art Student’ you may only list Materials, Equipment and Services on our Market. These items can be new or used they can be sold or exchanged and no commission is taken for these items. You must provide accurate information. Please be aware that We are not responsible for items posted here nor are We responsible for payment, postage or collection. This Service is between User (Seller) and User (Buyer). Please contact the person who submitted the market item by clicking their profile and either choosing ‘Email’ or ‘Send Private Message’ Users (Seller). Any member posting ‘Original Artworks’ or ‘Digital Artworks’ here will be banned from using our Market, and all their Market items will be removed. Please note our Moderators will be looking through our Market items to make sure our Terms and Conditions are being kept.

Requested information

For selling Artworks: In order to sell “Original Artworks” or “Digital Artworks” on Our Site You must provide Students Art World and The Student Art Company with all information requested.

Applying for a role or account type: When applying for a role You may be required to verify your identity by separately providing Us with a copy of your Education ID and/ or government-issued ID and/ or similar documentation. You must provide us with accurate, complete and current information. We will contact you through accountverification@studentsartworld.com Please also reply to this E-mail Address.

Guidelines: Please see our Guidelines for posting Artworks here: guidelines. Students Art World reserves the right to remove or edit any ‘Market Item’, ‘Artwork’ or ‘Any Content’ without notice to You to ensure that they comply with our Guidelines and Terms. Please note your Artworks, market items or any other content may not be immediately available or searchable by keyword or category for several hours. Some content will be sent for Moderation and will only be published upon our Moderator’s approval. If your content is disapproved it will be removed from Our site. You may contact us at support@studentsartworld.com if you wish discuss any content which has been disapproved or not published.

Remove Content: If you want to remove any Artworks, Items or Content simply go to “Manage” and select delete. If you are having any problems please check our FAQ or Contact support@studentsartworld.com.

Privacy: Please Read Our Privacy Policy at www.studentsartworld.com/page/privacy-policy for information and notices concerning all content and personal information. Please note by Agreeing to our Terms and Conditions you are also indicating that you have read our Privacy Policy. Copyright Policy: You acknowledge and agree that: (i) You are solely responsible for all Original Works of Art and Digital Works that you make available thought the Site and Services. (ii) You are the creator and exclusive owner of all such Original and Digital Artworks or you have all rights, licenses, consents and releases that are necessary to grant Students Art World and The Student Art Company the right to use, advertise and publish these Artworks. (iii) Neither the Original Works or Digital Works that you make available through the Site and Services infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation. We respect copyright law and expect our Users to do the same. We reserve the right to terminate Member’s Accounts and Account holders who repeatedly infringe or are believed to be repeatedly infringing the rights of copyright holders.

Online sales: If you submit Original Artworks or Copies, you hereby appoint Students Art World and The Student Art Company as an independent non-exclusive reseller with the right to resell such Original Works of Art through the Site and Services and on third party websites. And you hereby grant Us a worldwide transferable, nonexclusive, right and license, with a right to sublicense, to (i) use, reproduce, distribute, license, publicly display, transmit and broadcast copies of the Original Work of Art and Copies in any form or medium or technology for the purposes of promoting Students Art World and The Student Art company, the Site and Services.

Purchaser (Buyer) terms and conditions: As a Member you may purchase Original Artworks or Copies that are listed by other members on the Site.

Taxes: All prices are inclusive of VAT (where applicable)

Colour: Please note there are always differences between the colours of Artworks seen online and their colours when printed or in their original form. Artworks are the responsibility’s of the Sellers, if there are any serious issues with the artwork where the artwork advertised online and the artwork you received. Please photograph the artworks you received and email it to support@studentsartworld.com please attached the photograph and include the order number and your username. You must contact us using the same email address that you are currently registered with. We will review your Email and reply accordingly.

Feedback: We welcome and encourage you to provide feedback, comments and ideas to improve the Site and Services. You can click Ideas to post new ideas or comment and vote on existing ones alternatively you can email us at feedback@studensartworld.com

Usage of Your content: By making content available on the Site (i) You grant Students Art World and The Student Art Company a worldwide, non-exclusive, transferable, royalty-free, commission-free license to crop, resize, publicly display, publicly perform, distribute, broadcast and transmit such content on or through the Site and Services in any form, medium or technology, for the purpose of promoting Students Art World and The Student Art Company. (ii) You grant other ‘Members’ the right and license to view your content on or through the Site and Services. You reserve all rights and licenses to any Content that you make available on or through the Site and Services. You acknowledge and agree that you are solely responsible for any Content that you make available on or through the Site. You represent and warrant that: (i) you are the sole and exclusive owner of all Content that you make available on the Site and that You have all rights, licenses, consents and release that are necessary to make available such Content and to grant all rights and licenses in such content under these Terms.

Students Art World Content: This website contains material which is owned by or licensed to, the design, layout look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms and Conditions.

All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website.

Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

General Prohibitions: You agree not to do any of the following:

(1)    post, upload, publish, submit or transmit any text, graphics, image, software, music audio, video, information or other material that (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights, or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; (vii) harms minors in any way; or (viii) promotes illegal or harmful activities or substances.
(2)    Use, display, mirror or frame the Site, or any individual element within the Site, Students Art World or The Student Art Company names, any trademark, logo, or other proprietary information, or the layout and design of any page or form contained on a page, without Students Art World or The Student Art Company’s express written consent;
(3)     Access, tamper with or use non-public areas of the Site, Students Art World or The Student Art Company’s computer systems, or the technical delivery systems of Our providers.
(4)    Attempt to probe, scan or test the vulnerability of any of Our systems or network or breach any security or authentication measures;
(5)    Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Us or Our provider’s or any other third party (including another user) to protect the Site, Services, Students Art World or The Student Art Company or Member content.
(6)    Attempt to access or search the Site, Services, Students Art World or The Student Art Company or Member’s content, or download content from the Site or Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) Other than the software and or search agents provided by Us or other Generally available third party web browsers.
(7)    Send any unsolicited or unauthorised advertising, promotional materials, email, junk mail, spam, chain letters or other forms of solicitation;
(8)    Use any meta tags or other hidden text or meta data utilizing Our logo URL or product name without Our express written consent.
(9)    Use the Site, Services, Our Content, or Member Content for any commercial purpose or the benefit of any third party in any manner not otherwise permitted by these Terms.
(10)    Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Site, Services, Students Art World or The Student Art Company or Member Content to send altered, deceptive or false source-identifying information.
(11)    Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site, Services, Our or Member content.
(12)    Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site.
(13)    Collect or store any personally identifiable information from the Site or Services from other uses or the Site or Services without their express permission.
(14)    Impersonate or misrepresent your affiliation with any person or entity.
(15)    Violate any applicable law or regulation or
(16)    Encourage or enable any other individual to do any of the foregoing. Students Art World and The Student Art Company have the right to investigate and prosecute violations of any of the above to the fullest extent of law. Students Art World and The Student Art Company may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms. You acknowledge that Students Art World and The Student Art Company has no obligation to monitor your access to or use the Site or Services or to remove any Member Content, but has the right to do so for the purpose of operating the Site and Services, to ensure your compliance with these Terms, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. Students Art World reserves the right, at any time without prior notice, to remove or disable access to any Member Content, Listings, for Original Works of Art or Copies, Students Art World and The Student Art Company Content or any other text, graphics, images, software, music, audio, video, information or other content or material that Students Art World or The Students Art Company, at its sole discretion, consider to be objectionable, in violation of these Terms or otherwise harmful to the Site or Services.

Ownership: The Site, Services and Students Art World Content are protected by copyright and other laws of the United Kingdom and foreign countries. Except as expressly provided in these Terms, Students Art World and The Student Art Company exclusively own all right, title, and interest in and to the Site, Services and Students Art World and The Student Art Company Content and printed works, including all associated intellectual property rights. You will not remove, alter or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Site, Services or Our Content.

Links: From time to Time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s). When an external link is provided you will see a small icon (favicon) next to them this is an indication that you are leaving our website. All internal links do not have this icon. You acknowledge sole responsibility for and assume all risk arising from Your use of any such link leaving Our Site.

Indemnity: You agree to defend, indemnify, and hold Students Art World, its directors, employees, agents, Moderator’s harmless from and against any clams, liabilities, damages, losses and expenses including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Site, Services, Students Art World or The Student Art Company content or Member Content, or your violation of these Terms.  

Payments: Payments are made through PayPal and Google Checkout. Secure online payment service provider’s. Buyer’s must pay via these two secure methods. If students want to be paid via bank transfers please send an email to payments@studentsartworld.com stating your username and a phone number that we can contact you on. Please note we will only respond to you if you use the same email address that is registered with your account.

Limitation of Liability: Your use of any information or materials on this website is entirely at your own risk for which we shall not be liable. It shall be Your own responsibility to ensure that any products, Services or information available through this website meet Your specific requirements.

Controlling Law and Jurisdiction: These Terms and any action related thereto will be governed by the Laws of London, United Kingdom. Without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the courts located in London, United Kingdom and each of the parties hereto waves any objection to jurisdiction and venue in such courts.

Entire Agreement: These Terms constitute the entire and exclusive understanding and agreement between Us (Students Art World and The Student Art Company) and You regarding the Site and Services and these Terms supersede and replace any and all prior oral or written understandings or agreements between Us (Students Art World and The Student Art Company) and You regarding the Site and Services.

Assignment: You may not copy, edit or transfer these Terms, without Students Art World or The Student Art Company’s prior written consent.

Notices: Any notices or other communications permitted to required hereunder, including those regarding modification to these Terms, will be in writing and given: (i) by email (ii) by posting the updated on the Site, You will be required to re-accept the new Terms. For Dates please refer to Date Updated at the end of the Terms.  

General: Students Art World and The Student Art Company will do Our best to ensure and verify that the Artworks created by ‘Art Students’ have been produced by current Students and Art Students studying at a College or University. However we cannot be held responsible in the event of false information filled by a new or existing member to the site. Art Students and Students remain Students until 5 years post graduation.

Order Cancellation: You (the Buyer) have the right to cancel your order within 24 hours of purchase. This must be done in writing by email to cancelorder@studentsartworld.com Please note after 24 Hours have passed it is up to the Seller (Student or Art Student) to confirm that they have not yet posted the Artwork. If they confirm that they have not yet posted the Artwork then the Cancelation will be approved and we will refund You (the Buyer) with both the Artwork and Postage cost paid. However If the Seller has already posted the Artwork then You (the Buyer) may discuss returning the artwork to the Student at their discretion. Please note at this point you will need to arrange everything between your selves. This includes, Delivery and refund of money etc. Please be aware that We have completed our transaction Service and therefore keep any commission for the sale of the Artwork.

Postage & Packaging

Overview: Please only use recorded and or signed for and or insured postage methods. It is the responsibility of the Seller to make sure that artworks arrive to the buyer’s. therefore if any disputes arise Buyer’s will be refunded the amount paid for the Artworks, and the Sellers would be responsible to claim on the postage insurance. We advise all students to wait 25 hours before dispatching their Artworks.

Postage Liability: Students Art World and The Student Art Company will not be held responsible if artworks are: lost or did not arrive or were not dispatched or not delivered at all. We will however do our best attempt to informing buyers and sellers that All Artworks Must be dispatched within 10 working days of purchase. Should you specifically require the artwork sooner, please contact us to discuss other possibilities. Please note We advise all students to wait 25 hours before dispatching their Artworks (This is to allow Buyer’s a chance to Cancel their orders should they want to within their 24 Hour allowance).
We recommend using both Signed For and Insured posting methods only. This way all parties know when or if the package has arrived by contacting the postage provider. In the event of Artworks being lost or not delivered for any reasons, Seller’s can claim the value of the artwork with the postage company directly. Sellers can dictate which postage options are available therefore if there are any issues with Artworks not arriving it is the responsibility of the seller and not Us.

Buyer’s: The majority of packages dispatched will require a signature on delivery. It is vital that customers provide a delivery address where someone will be able to sign for the delivery between 08:30 and 13:00 weekdays and Saturdays. Should you be away at those times you will normally receive a note that you can pick up your package at a specific postage collection point. Please contact the Delivery Company for more information on this. We are not responsible for packages that were delivered, when no one was there to collect them.

Issues with Delivery: (Applicable to UK Mainland addresses only) If Artworks have not been delivered after 31 days since ordered and after We have spoken with both the Seller and Buyer, If We have not resolved the Issue. We will refund the buyer the amount paid for the Artwork and it will be the responsibility of the Student or Art Student to claim the postage Insurance to cover the loss on their side. Please note in some circumstances the postage fee may not be refundable.

European and Worldwide delivery times may take longer, depending on which delivery method was chosen. At first instance please contact Postage or Delivery Company to enquire about the whereabouts of the package.

For all issues with delivery please contact Support@studentsartworld.com please state in the subject “Issue with Delivery Order Number ___” (include the order number).   

Packaging: Sellers must make sure their artworks are well packaged. Additional expenses for packaging should be added to any existing postage cost. E.g. Postal tubes, Boxes, Bubble wrap etc.

Returns: Any of the Artworks on the website cannot be exchanged or refunded. Please note that there will always be slight colour variance between the image seen on screen and the final product. Also, when originals are produced; the very nature of these artworks stipulates that no two artworks will ever be exactly the same. Artworks cannot be returned for either of these reasons. If you have purchased a Original Artwork or a Copy that has arrived and is significantly different from the Original picture advertised on Our Site please photograph the Artwork as soon as you receive it, and email it to support@studentsartworld.com Please state in the subject “Issue with Artwork” please attach the photograph that you have taken and also include the order number.

Contact Us: While in most cases you will receive a very quick response to your enquires in some cases where we need to contact other people or Company’s it may take slightly longer for a response. We will do Our best to contact you as soon as possible.
